A Users' Guide to the United States Constitution
Helpful Votes: 1 out of 1 total.
Review Date: 2004-11-19
American Constitutional Law: An Overview, Analysis, and Integration (Carolina Academic Press, 2004) is neither a casebook nor a treatise upon the constitution, although it incorporates significant aspects of both. It is, instead, a clear, methodical and complete guide to the constitutional forest, including detailed examinations of exemplary constitutional trees, learning exercises, and references to additional resources.

Written by Catholic University of America, Columbus School of Law Professor William A. Kaplin, this book would be an ideal reference to supplement the law or graduate school curriculum, to guide and orient undergraduate coursework on American democratic constitutionalism, and for the non-lawyer seeking an integrated understanding of the context and processes of American constitutional law.

Guided by the convictions 1) that one must develop an integrated view for full and effective understanding of constitutional law, 2) that "classical" cases and commentaries remain of vital importance to this understanding, and 3) that "constitutional law is too important to be left solely to the lawyers," Kaplin brings his expertise as lawyer and consummate educator, his patience and precision as an analyst, and his talent for synthesis and explanation to bear on the United States Constitution and the concepts, distinctions, principles, precedents and processes which have informed its interpretation.

The book is meticulously organized, introducing the United States Constitution, approaches to interpretation, and the role of the judicial opinion as a "basic practical tool" of constitutional law, before examining in detail constitutional powers - including enumerated legislative, judicial and executive powers as well as federalistic limits on state powers - and constitutional rights - including equal protection and due process rights as well as freedom of expression and religion. The presentation of substantive law and principles is illuminated throughout the book through analysis of "classical" and foundational cases. Additional illustrative material is also presented from classic commentators, such as James Madison and Joseph Story, as well as from history, political science, and legal theory.

Kaplin's presentation of constitutional powers is guided by the structural interpretive principles of federalism and separation of powers and supplemented by practical exercises, further "Study Suggestions," and a timeline identifying critical developments in legislative, executive or judicial power. The presentation of constitutional rights is guided by the state action doctrine and a "values" approach to interpretation, and is supplemented by a timeline identifying major developments in rights to the present, in addition to practical exercises and further "Study Suggestions."

Having presented constitutional powers and rights issues, Kaplin begins the process of integration by examining their confluence in questions including relationships between federal constitutional rights and federal statutory rights, federal constitutional powers and federal constitutional rights, and federal constitutional rights and state constitutional rights. This integration continues through an examination of the processes of constitutional litigation and constitutional interpretation, and an integrated model of constitutional analysis.

I had to buy this book for a college architecture class that I am taking and I saved about 40 bucks buying it from Amazon instead of my college bookstore. This book is great for any architecture student or anyone who is interested in drawing houses using AutoCad. It is also great for any beginner because it shows you how to begin a drawing and how to complete it. It is very easy to read and it is full of everything you need to know to draw like an architect.

BLOSSOM COUNTY FAIR is stirring up a bit of dust. The good folks don't want a carnival added to their fair. Two years ago a charlatan fortune-teller set them up to lose their money.

Blake Gray Feather is the Blue-Ribbon cowboy who is helping to promote interest in the Rodeo and fair. He has come home after 8 years on the road following the Rodeos. He had lived with Cindy Tucker and her grandfather until he was 18 when he lit out. Cindy was 14 at that time.

Now he is home and Cindy wants him to help her learn how to attract a man. She kind of down plays her school girl crush on Blake in hopes that she can learn the tricks of attraction between a man and a woman.
She is now 22 years old and doesn't want to be left on the shelf [spinster shelf that is]. Blake is 26 and not ready to settle down yet but is being persued by Jessica, a barrel racing cowgirl.

We are introduced to Blake's friends from high school day, the Mayor Jason Strong and the Sheriff Trace McCabe [their stories are coming up next in this series]. Also we run into Cherry, a young woman with a "gift" who is going to make life miserable for the Mayor.

Whoops! All of a sudden Blake is starting to realize that Cindy is not the young "sister" he left behind. She has turned into a beautiful woman.
Must be the kisses that helped.

HIGHLY RECOMMENDED for good clean fun and a perky story plot that leaves you really believing in love.

By 1992, Esmeralda Sanchez had become so desperate to cross the border into the United States, she paid the dreaded coyotes to escort her and her six-year old son, Jaime. However, the journey inside a hot car trunk goes wrong, leaving Jaime dead and his mother near death. American Pete Ross is involved with a drug deal when he manages to save the life of Esmeralda, who is deported back to Mexico. The shock of the incident is so great, Pete joins the Border Patrol.

Over the next four years, Pete falls in love with Esmeralda, who has become a renowned healer due to her ability to get in touch with Jaime. Her touch placed skeptical Pete's cancer in remission. At the same time, local leader Ramon Cruz plans to bring his form of justice to the mean streets of El Paso. They begin by blowing up the border patrol station, killing many people. If Pete, Esmeralda, and Pete's ex wife Dr. Ana Gutierrez don't find a way to stop Ramon, the bloodbath could reach biblical proportions.

BRIDGE OF SHADOWS is a well-written combination of an- otherworldly and suspense thriller within a relationship drama. The illegal immigration question that haunts the Mexican-American border is well done as various sides of the argument are presented with dignity and grace. The story line is filled with action. However, it is the four main characters, brilliantly symbolizing the different aspects to the border issue, while still being fully developed people that turn Roxanne Conrad's novel into a must read for sub-genre fans.

I really enjoyed this novel. It is the final of the Huntington Family series. It is about Kerrianne whose husband died 4 years prior and it deals with her hesitancy at wanting to move on. She thinks that if she dates other men, it is somehow being unfaithful to her dead husband. She meets Ryan Oakman who is a widower. She can relate to him since they have both lost a spouse and are now single parents. At first, she resists him. What unfolds is a beautiful love story between two people that find they can love again. I also enjoyed seeing bits of other members of the Huntington family. Other books that I enjoyed were No Longer Strangers and Winter Fire and the characters from those novels made cameos in this one. If you're up for a sweet love story, check this one out.

Orkin provides a hysterical twist and satirical work on Canadian English. It promotes the glory of Canada and the foolishness of the U.S. As an American, I found it hysterical to be referred to as the "Hugh Ess!" A must read for both Canadians and Americans.

Buy it, enjoy it!!! I've recently had a friend who quit his job as a correctional officer to move to the Keys because of this book, and others in the series. Maybe it won't affect you quite as drastically, but you'll like it I'm sure. Especially if you are a Travis McGee fan.

This is a refreshing and inspiring collection of essays about people who refuse to believe "you can't fight city hall." Subtitled "Political activists in a cynical age" it traces the stories of people who used the political system to affect public well-being. Examples include MADD (mothers against drunk driving); Dr. Kristen Zarfos, the breast cancer surgeon whose grass roots efforts stopped "Drive Through Mastectomies;" and Rosa Parks bus segregation protest. I'm famiiliar with Dr. Zarfos story, and this book tells it beautifully. Read this book yourself and give it to anyone who complains about how irrelevant politics has become!
